1. The service
Momentoid is a mobile app for capturing photos, creating polaroid-style photo memories, applying analog-inspired filters, adding notes, saving images, and sharing your creations. Features may change over time as the app is improved.
2. Eligibility
You must be old enough to use mobile apps and make purchases under the laws of your country or have permission from a parent or legal guardian. You are responsible for keeping your device and Apple account secure.
3. License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Momentoid for personal, lawful purposes according to these terms and the App Store rules. Momentoid is licensed, not sold.
These terms are in addition to Apple's standard App Store terms, including the Apple Licensed Application End User License Agreement, unless a separate agreement is required by applicable law.
4. Acceptable use
You agree that you will not:
- Use the app for unlawful, harmful, abusive, deceptive, or rights-infringing activity.
- Upload, create, or share content that violates another person's intellectual property, privacy, publicity, or other rights.
- Reverse engineer, decompile, modify, resell, rent, or exploit the app except where allowed by law.
- Interfere with app security, purchases, analytics, notifications, or third-party infrastructure.
- Use automation, abuse, or fraudulent behavior to access premium features or disrupt the app.
5. User content
You retain ownership of photos, captions, notes, and other content you create or import through Momentoid. You are responsible for your content and for ensuring you have the rights needed to use, edit, save, and share it.
You grant Momentoid the limited permission needed to process your content inside the app so features such as capture, editing, filtering, framing, saving, and sharing can function.
6. Premium features
Momentoid may offer free features, premium features, one-time purchases, subscriptions, introductory offers, or free trials. Premium access may be required for unlimited memories, premium filters, app lock, or other paid features shown in the app.
Feature availability, pricing, trial eligibility, and purchase options may vary by country, platform, app version, and App Store configuration.
7. Payments and renewals
Purchases and subscriptions made on iOS are processed by Apple through the App Store. Your Apple ID will be charged according to the price and terms shown before confirmation.
If a subscription is offered, it may automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple account settings. Deleting the app does not automatically cancel a subscription.
If a free trial is offered, unused trial time may be forfeited when you purchase a subscription, where permitted by Apple rules.
8. Refunds
Refunds for App Store purchases are handled by Apple according to Apple's policies. We cannot directly issue App Store refunds. If you believe you were charged incorrectly, request a refund through Apple support or reportaproblem.apple.com.
9. App availability
We try to keep Momentoid useful, stable, and available. However, the app may be interrupted by maintenance, operating system changes, device issues, third-party service outages, platform policy changes, or technical failures. We do not guarantee uninterrupted access or that every feature will remain available forever.
10. Third-party services
Momentoid may rely on third-party services for purchases, analytics, notifications, hosting, app infrastructure, and platform functionality. These services may have their own terms and policies. We are not responsible for third-party services outside our control.
11. Privacy
Your use of Momentoid is also governed by our Privacy Policy, which explains how information is handled when you use the app.
12. Intellectual property
Momentoid, including its app design, branding, graphics, interface, text, software, and related materials, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from Momentoid except as allowed by these terms or applicable law.
13. No professional advice
Momentoid is a creative photo app. It does not provide legal, financial, medical, professional, archival, or backup advice. You are responsible for making independent decisions about how you store, back up, share, or publish your content.
14. Disclaimers
Momentoid is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation.
15. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, photos, revenue, profits, goodwill, or business opportunities arising from your use of or inability to use Momentoid.
Nothing in these terms limits liability that cannot legally be limited under applicable law.
16. Termination
We may suspend or terminate access to the app or certain features if you violate these terms, misuse the app, create risk for other users or the service, or where required by law or platform rules. You may stop using Momentoid at any time.
17. Changes to terms
We may update these terms from time to time. The latest version will be posted on this page with the effective date. Continued use of the app after updates become effective means you accept the revised terms.
18. Governing law
These terms are governed by applicable law, without regard to conflict of law principles, except where local consumer protection laws require otherwise. Some users may have additional rights under the laws of their country or region.
